LAWMA AI App – Terms of Use
Introduction
These Terms of Use (“Terms”) govern your access to and use of the LAWMA AI application (the “App”), which is operated by LAWMA Holdings, Inc., a Utah corporation (“LAWMA,” “we,” “our,” or “us”). The App may be embedded or displayed on a third-party client website (the “Client Website”).
By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.
1. Nature of the Service
The App is an artificial intelligence-powered engagement tool that facilitates communication between you and the operator of the Client Website. LAWMA provides the technology platform only; LAWMA does not itself provide, sell, or guarantee any products or services offered by the Client Website.
2. User Information and Data
When you provide information through the App (including your name, email address, or phone number), you consent to its use for purposes of responding to your inquiry, scheduling, or other communications as described in our Privacy Policy.
The Client Website operator is responsible for how it uses your information. LAWMA disclaims any responsibility for the acts, omissions, or practices of the Client Website operator.
3. TCPA Compliance
If you provide a phone number through the App, you acknowledge and agree that:
– Any text messages or calls you receive are initiated by the Client Website operator, not by LAWMA.
– The Client Website operator is solely responsible for obtaining any consent required under the Telephone Consumer Protection Act (TCPA) or similar laws before sending such communications.
– LAWMA expressly disclaims liability for any claims, damages, or penalties arising from calls or text messages sent by or on behalf of the Client Website operator.
4. Prohibited Conduct
You agree not to:
– Use the App for any unlawful purpose;
– Attempt to interfere with or disrupt the operation of the App;
– Provide false or misleading information;
– Copy, modify, or reverse-engineer any part of the App.
5. Intellectual Property
All rights, title, and interest in and to the App (including software, algorithms, branding, and content) are owned by LAWMA or its licensors and are protected under U.S. intellectual property laws. Your use of the App does not grant you any ownership rights.
6. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LAWMA DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAWMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws rules.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in Salt Lake County, Utah. Arbitration shall proceed on an individual basis only.
9. Modifications
LAWMA reserves the right to update or modify these Terms at any time. Updated Terms will be posted with a new Effective Date, and your continued use of the App constitutes acceptance of the updated Terms.
